PACIFIC OAKS FCU ANNUAL PRIVACY NOTICE AND DISCLOSURE

Our commitment to protecting your privacy.

Pacific Oaks FCU is committed to protecting and safeguarding the confidential information of its members. Throughout its history Pacific Oaks FCU has never shared non-public personal information about its members with any outside party except with the member's consent, as required in order to carry out the member's authorized financial transactions, or as required or permitted by law.

Last year you received Pacific Oaks FCU's initial notice and disclosure of its privacy policy, as required by a law that went into effect in 2001. That law also requires that each year we provide you with a follow-up disclosure of our Privacy Policy, which is the purpose of this article. It is important to us that you understand how seriously Pacific Oaks FCU takes its commitment to protect your nonpublic personal information, and the care we invest to protect that information.

The federal privacy law requires that you be given the right to "opt out" of disclosure of any of your non-public personal information to certain "unaffiliated third parties" before any financial institution can make such disclosures. However, since Pacific Oaks FCU never shares your non-public personal information in any manner subject to this "opt out" provision, you do not have to take any action to receive the maximum protection provided by the Federal Privacy Law -- Pacific Oaks FCU already has taken steps to assure you that protection. The information in this article is being provided to advise you of your Credit Union's policies and to assure you that Pacific Oaks FCU carefully protects the privacy of your confidential information, consistent with all legal privacy requirements and our own high standards.

CONFIDENTIAL INFORMATION AND PACIFIC OAKS FCU FINANCIAL SERVICES

Collecting information.

In order to provide you the highest quality financial services we can, we must gather non-public personal information, such as your name and address, from information you give us (for example on applications or other forms). We also gather information about your transactions and account transactions with us, or others, information we receive from consumer reporting agencies as provided by law (such as your credit history), information obtained from third parties in verifying information you have provided on an application or other form (such as from a current or former employer or other financial institutions where you do business), and other information which you authorize us to obtain.

Disclosure and use of your confidential information.

In providing you with financial services and products, we may disclose certain non-public personal information, such as information we receive from you, information derived from your transactions with us or companies working under contract with us (such as account balances, payment history or credit card use), or information obtained by us from a consumer credit reporting agency, such as your credit history. Pacific Oaks FCU may disclose such categories of information to unaffiliated companies that perform services for us under "service provider" agreements (for example to print and mail your account statements), or to companies with whom we have entered into joint marketing agreements to provide or offer you financial products or services. All of those companies have agreed in writing to protect the confidentiality of all information they receive and to use it only for the purposes for which we have contracted with them. Disclosure of information under these types of "service provider" contracts or "joint marketing" agreements is specifically allowed and regulated by the privacy law.

None of your confidential information is disclosed to any other category of affiliate or nonaffiliated third party, except as specifically permitted or required by law (such as to a credit reporting agency or in response to a court order), or as authorized by you. No member's confidential information is shared with non-affiliated third parties except as permitted or required by law, and none of your nonpublic personal information is ever sold to any party.

Protecting your nonpublic personal information.

We take very seriously our obligation to protect your non-public personal information. In order to do so, it is the policy of Pacific Oaks FCU that any confidential member information is only accessible to those employees, vendors and service providers who need the information in order to provide products or services to you. All Pacific Oaks FCU employees are bound by strict policies of confidentiality, which prohibit them from sharing your confidential information or using it in any way other than to provide services and products. We implement our policies by regularly training staff how to properly handle and maintain your non-public personal information. In addition, we maintain physical, electronic and procedural safeguards to assure protection of your confidential information. These privacy protections comply with federal regulations and our own high standards, and are periodically updated. All service providers with which Pacific Oaks FCU does business, or companies with whom we have a joint marketing agreement, also must agree in writing to comply with our strict policies on the confidentiality of member information. It is important our members know we will never do business with any vendor or service provider who does not agree to maintain the confidentiality of your non-public personal information consistent with Pacific Oaks FCU's policies. And if for any reason you should cease to be a member of Pacific Oaks FCU, we do not share any non-public personal information about former members, except as permitted or required by law.
